Is Delta 8 THC Legal in Texas & Where to Buy in 2021?

However, the federal government has still made delta 9 THC (marijuana) illegal. 

 In short, the law states that hemp and cannabis-derived products are legal as long as any product has less than 0.3% THC. 

 On the other hand, Federal law is looking to ban any type or version of delta 9 THC, whether it is delta 8 THC or not. However, it has been a confusing process. The DEA, who is in charge of enforcing the farm bill, has not pursued any legal action against popular delta 8 THC suppliers, distributors, manufacturers, or consumers. We believe the government is starting to accept delta 8 THC has a natural compound derived legitimately from hemp. 

 As it stands, Delta 8 THC is legal and isn’t going anywhere anytime soon.

Is Delta 10 THC Legal?

While there are no specific rulings on Delta 10, the majority of the industry leaders believe Delta 10 THC will remain legal based on the current ruling of delta 8 THC.

Delta 10 THC has a completely different chemical compound than its close relative, Delta 9 THC, rendering it a different hemp product. Under the 2018 Farm Bill definition, Delta 10 THC is legal.

Can I buy Delta 8 THC without a Medical License in Texas?

The short answer is, Yes! Anybody over the age of 21 can purchase Delta 8 THC if it is made from hemp in Texas without a medical license.

However, Delta 8 THC that is procured from marijuana will require a medical license. People can be prescribed low traces of THC cannabis with a legitimate medical condition under the Texas Compassionate Use Act.

The process of obtaining a medical license will require individuals to see a physician about their conditions first to see if they can qualify for medical marijuana. Many doctors will gladly consult a patient over the phone and/or online to see if their conditions can qualify under Texas Compassionate Use Act.

Although individuals can sense that their prescription for medical marijuana in Texas protects them from any unlawful behavior, the federal regulations on marijuana are still in effect. Anyone who is caught with delta 9 THC (Marijuana) can still be prosecuted under federal law. However, we have yet to see this law strictly enforced by the DEA nor ATF.
